Sales, Returns & Refunds

Terms of Sale

By completing and submitting an electronic order, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Certain steps must be followed for a binding contract to be formed between us, which are described below.

After you have placed your order:

  • We will send you, as soon as possible, an email to acknowledge your order. It will confirm which goods you have ordered. This email is not an order acceptance from us and at this stage no contract is formed between us;
  • when we despatch your goods from the warehouse, we will send you a confirmation email (“Despatch Email”). This email constitutes a formal acceptance of your order by us. This also means that a binding contract between us is formed and you and we are obliged to fulfil our obligations under that binding contract.

We Do Not Have To Accept Your Order, And In Particular, We Will Not Accept Your Order If:

  • we do not have the goods in stock/the goods in stock appear to be damaged;
  • your payment is not authorised;
  • there is an error on our Website regarding the price or other details of the goods;
  • you have cancelled your order. 
  • We will be in contact with you as soon as practicable (by email or by phone) in each of the above circumstances to discuss your options. We reserve the right to refuse any order.
Warranties

We ensure that all our products are of the highest standard and quality, and we will guarantee all items against manufacturing defects.

If you receive a defective item, please get in touch with us within five days of receiving it to advise. We may ask you for the following:

  • A receipt for your goods
  • Images of the defect
  • Details of how the item has been used

If you have an issue with any of our products after this period, don’t hesitate to contact us; we shall try and resolve the issue within reasonable parameters.

What is not covered by our guarantee:

  • Accidental damage
  • Misuse of the item
  • Normal wear & tear
  • Loss
  • Theft
  • Not following the care guidelines

All of our watches come with a 1 year warranty. This excludes the points listed above.

This guarantee will be void if your item is repaired or adjusted by another jeweller or company.

Your statutory rights are not affected.

     

     

    Terms of Repairs

    We are not responsible for identifying any repair (or other) issues that have not been specified by you. If we do find any independently, we shall inform you before repairing them. Once the repair has begun you are committed to the completion of the repairs. 

     

    We do not guarantee that we can repair your item. We must first examine your item to determine: 

        1. If the repair can be completed successfully; 
        2. The need, availability and cost for parts and appropriate repair personnel; and 
        3. How much the repair will cost. 

        HC Jewellers will give a guideline for the length of the repair. This is not a guarantee or deadline. If any delays are caused due to unavailability of parts or suppliers HC Jewellers are not responsible. 

         

        Items that have been subject to wear and tear, aged or been used inappropriately or extremely may result in attempted repairs damaging the item or its parts. HC Jewellers are not liable for any damage caused by attempted repairs but shall make a reasonable attempt to repair such damage. You acknowledge that such damage may not be reasonably repairable. 

         Addition for Watches:

        You agree that your watch will be checked against the Watch register. If found to be stolen we shall hold the watch and inform the authorities. The watch will not be returned to you. 

         

        If submitting a vintage watch, we are unable to guarantee the accuracy of the returned watch.  

        Terms of Cancellations
        If you wish to cancel your order:

        • Items that are not custom orders
          • You must notify us by email at info@hcjewellers.co.uk and provide your order number. Cancellations will only be accepted before the order has been dispatched. Cancellation of your order is not accepted until a confirmation email has been received by you from us. Cancellation disputes are only valid upon a legitimate confirmation email from us.
        • Items that are custom orders
          • You must notify us by email at info@hcjewellers.co.uk and provide your order number. Cancellations will only be accepted within 48 hours of the payment being made. Cancellation of your order is not accepted until a confirmation email has been received by you from us. Cancellation disputes are only valid upon a legitimate confirmation email from us.

            We reserve the right to accept cancellation for bespoke orders beyond 48 hours after payment has been made.

        Terms of Returns

        Returns are only accepted within 14 days for unused items or jewellery that is still in the original packaging.

        • Online orders are 14 days after you sign for the delivery or 21 days after payment, whichever comes first.
        • Shop-bought items are the 14 days following payment.

        Initiating a return must be done within the period above.

        Note: This excludes bespoke and special-order items, as well as earrings for hygiene reasons.

        The cost of returning the item to us shall be covered by you. We will accept returns made through post or hand delivered to either of our stores.

        If an item is returned through the post, it is advised that you obtain postal insurance and send it recorded delivery with electronic proof. Until a parcel has been received by us, we are not liable for any losses incurred during the returns process.

        Upon receipt of the item and following a full inspection by ourselves where items are received in the original & unused condition, HC Jewellers will give you a full refund of the amount paid or an exchange credit as required. Refunds can only be made onto the same card as used for the original purchase.

        Returns Exclusion Policy

        The rights to return the goods to us as referred to above will not apply in the following circumstances:

         

        • If following our inspection, there is deemed to be any damage or wear to the item.
        • If items are returned after the applicable period.
        • If there are any faults on the items on delivery and HC Jewellers have not been notified within 5 days of receipt.
        • If any product has been made or customised specifically for yourself.

        This does not affect your statutory rights.

        Postage

        UK Delivery:

        Orders under £75

        • £4 – Royal Mail 2nd Class (2-3 working days)
        • £7.50 – Royal Mail Special Delivery (1-2 working days when ordered before 1pm)
        • £12 – Royal Mail Saturday Special Delivery (when ordered before 1pm on Friday)

        Orders between £75 & £149.99

        • FREE – Royal Mail 2nd Class (2-3 working days)
        • £7.50 – Royal Mail Special Delivery (1-2 working days when ordered before 1pm)
        • £12 – Royal Mail Saturday Special Delivery (when ordered before 1pm on Friday)

        Orders over £150

        • FREE – Recorded next day UK delivery
        • FREE – Royal Mail Special Delivery (1-2 working days when ordered before 1pm)
        • £12 – Royal Mail Saturday Special Delivery (when ordered before 1pm on Friday)

        Custom created items

        If you would like to have an item customised, you can contact us by phone or email to discuss the price before the work is carried out if not already stated on the listing.

        The price will depend on the materials used, time taken and difficulty of the customisation.

        Bespoke Services

        If you have a bespoke item created by us, we shall go through all aspects of the design and materials used before any work begins. Customer satisfaction is our top priority, and we will work closely with you to ensure you have a truly special and unique item. This includes going through all of the costs beforehand so that you are happy with the knowledge you will be receiving your precious bespoke item at a price you are satisfied with.

        Additional costs not part of quotes

        If you have been quoted for a customised or bespoke piece of jewellery, any additional costs that may arise will be advised as soon as we are aware.

        Additional costs are usually but not exclusively due to:

        • Increase in cost of materials
        • A change in design by the client

        Disclaimers & Legalities

        We make every effort to make sure that the information on our website is correct, we do not warrant the accuracy & completeness of the material on our website. We may make changes to the material on our website, or to the products and pricing described in it, at any time without notice. The material on our website may become out of date & we make no commitment to update such material.

        It is the responsibility of the consumer to remain up to date with our terms of service, as well as how any changes may impact their experience with us. We will promote changes to the terms of service via our email channels so unless subscribed we have no way to provide notice to changes.

        Where a piece of our jewellery has more than one diamond, total carat weights will be listed, this is the combined weight of all stones within the piece.

        All images on this website are subject to copyright protection and may not be used without prior written consent. 

        You must have written consent to store any of our information in a private or public electronic retrieval system. No part of this website should be reproduced.

        You are allowed to print and download information on HC Jewellers’ website for your own use only and on the following basis:

        • No documents or related graphics on the website are modified in any way
        • Unless otherwise stated the copyright and other intellectual property rights in all material on HC Jewellers’ website are owned by us or our licensors.
        • For the purpose of these terms & conditions, any use of extracts from this website other than in accordance with the above information above for any purpose is prohibited.

        If you breach any of the terms & conditions your permission to use this website automatically terminates and you should discard any printed or downloaded images/extracts from HC Jewellers website.

        Service Access

        While we try to ensure HC Jewellers website is normally available 24 hours a day, 365 days a year, we will not be liable if for any reason this website is unavailable at any time or for any period of time.

        Access to the website may be suspended temporarily and without notice in the case of a system failure, repair or maintenance, or for any reason out of our control.

        Registration

        To register with HC Jewellers you must be over 18 years of age. Each registration is for one person only.

        HC Jewellers does not permit you to share your user name or password with anyone else or multiple users or a network. It is your responsibility to keep your password private, if you suspect someone else knows your password, you should contact us immediately.

        HC Jewellers may cancel or suspend your registration at our discretion, or if you breach any of your obligations.

        Governing Law & Jurisdiction

        These terms & conditions shall be governed by and construed in accordance with English law.

        Disputes arising in connection with these terms & conditions shall be subject to the exclusive jurisdiction of the English courts. We do not warrant that materials/items for sale on this website are appropriate or available for use outside the UK. It is prohibited to access the website from territories where its contents are illegal or unlawful. If you access this website from locations outside the UK you do so at your own risk & you are responsible for compliance with local laws.

        Website figures and pricing

        All prices on the website are inclusive of VAT. Prices may change without prior notice and are not guaranteed to be the same price between visits.

        Visitor Material & Conduct to this website

        Other than personally identifiable information, it is covered under the privacy policy, any material you transmit or post to HC Jewellers website will be considered non-confidential. We will have no obligations with such material. We will be free to copy, disclose, distribute, incorporate and use such material and all data, images, text and other things embodied therein for any and all non-commercial and commercial purposes.

        You are prohibited from transmitting or posting to or from HC Jewellers website any material for which you have not obtained all relevant and necessary licences and approvals.

        That constitutes or encourages conduct that would be considered a criminal offence that is threatening, obscene, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing,  inflammatory, in breach of confidence, in breach of privacy, scandalous or which may cause inconvenience or annoyance.

        Which constitutes or encourages conduct that could be considered a criminal offence, be contrary to the law of or infringe the rights of any third party or give rise to civil liability. Which could be technically harmful including, without limitation computer viruses, logic bombs, worms, harmful components, corrupted data or any other harmful data or malicious software.

        We will co-operate fully with any law enforcement or court order requesting or directing us to disclose the identity or locate anybody posting any material in breach of this.

        You may not misuse this website without limitation by hacking.

        Links to third-party websites on this website are provided solely for your convenience. If you use these links, you leave this website. HC Jewellers have not reviewed all of these third-party websites and do not control and are in no way responsible for these websites’ availability or content. We do not endorse or make any representation about them, any material found there, or any results that may be obtained from using them.

        If you decide to use any of these linked to our website, you do so entirely at your own risk. You may not create any links to our website. You shall fully indemnify us for any loss or damage we or any of our group companies may suffer or incur as a result of your breach of the above information.

You agree to indemnify us fully, defend & hold us, and our officers, directors, employees & agents, harmless from & against all claims, liability, damages, losses, and costs (including reasonable legal fees) arising out of any breach of the terms & conditions by you, or your use of this website, or the use by any other person using your registration details.

        Miscellaneous

        You may not sub-licence, assign or otherwise transfer any of your rights under these terms & conditions. If any provision of these terms & conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force & effect. Only the parties of these terms & conditions may seek to enforce them under the Contracts (rights to third parties act 1999)
